New York Adult Survivors Act and Child Victims Act

On May 24, 2022, the New York Adult Survivors Act was signed into law, amending the state’s statute of limitation for certain sexual offenses committed against individuals over the age of 18, regardless of when the alleged offense occurred. This act allows a one-year window for survivors to come forward beginning November 24, 2022 and allows civil lawsuits to be filed against individuals and the institutions where the sexual abuse occurred.

This new law is separate from New York’s Child Victims Act (CVA), which was enacted in 2019 and similarly permitted a one-year window for individuals who were previously outside of the statue of limitations for sexual abuse inflicted against them as a minor. The CVA’s “revival period” was ultimately extended through August 13, 2021, resulting in over 10,000 cases being filed in New York state courts under the Child Victims Act.
